About us

Neewer is an application that provides you with smart device control and management services by Shenzhen Neewer Technology Co., Ltd. and its related companies or subsidiaries (hereinafter referred to as "Neewer" or "us"). We are committed to protecting and respecting your privacy. This privacy policy was formulated in full consideration of your needs, personal information, and how we use this information.  Our aim is to ensure that you are the one that has ultimate control over the personal information provided to us.

 

About this Privacy Policy

Neewer Master application

Before you interact with our products, please read this privacy policy carefully to understand our intent and security measures to collect and handle your data, including how we use, store, share and transfer personal data.

 

Unless otherwise specified by the laws applicable in your region, "personal information" in this Privacy Policy means information that identifies a specific individual, either by itself or by association with other information. We will use this information in strict compliance with the Privacy Policy. Where required, personal information shall also include sensitive personal data or information based on the applicable legal classification.

 

We will consider that you fully understand and agree to this policy when you agree to the privacy policy, or start and continue to use our products or services, unless you get in touch with us through one of our means of contact to advise us otherwise.

 

Definition

In this policy,

*Affiliated company: refers to a company directly or indirectly controlled by Neewer; or directly or indirectly controlling Neewer; or jointly controlling the same company with Neewer; or directly or indirectly controlled by the same company as Neewer, including but not limited to the parent company and or any subsidiaries.

*Equipment: refers to the equipment produced, manufactured or provided by Neewer, mainly referring to photography, lighting equipment, etc.

  1. What information do we collect from you and how do we use it?
    1. The information we collect during your use of the service.

In order to provide our services to you, we require information from you that is necessary for the use of the services. We will only collect information that is necessary to fulfil a specific, particular, explicit and lawful purpose and will ensure that such information is not further processed in a way that is incompatible with that purpose. You have the right to choose whether or not to provide the information we request, but in most cases, if you refuse, we may not be able to provide you with the appropriate service or respond to the problem you are experiencing.

 

1.1.1  Provide basic account functions

Depending on the service you choose, we may collect personal information that you need to provide in order to use the respective service. When you register for an account with us, you will be required to provide us with an email address as your Neewer account name. You can also set a password for your Neewer account. This information is collected for the purpose of authenticating you when logging into your Neewer account and to gain access to the server services of the "NEEWER MASTER" application, where your account number and password will be encrypted. To improve the security of our systems when you use our products and/or services, to more effectively prevent phishing scam attempts and to protect the security of your account, we also verify your identity with an email verification code. To do this we need to collect your email verification code.

 

You can also quickly log into your Neewer account by associating a third-party account, such as a Facebook or Twitter account. We may need to collect your personal information in order to integrate with the Aurora SDK.   Please read the privacy policy of the relevant platform to understand how it uses and processes your personal data.

We will use your personal information in the following way: The username and password you enter for your account will be encrypted and transmitted to the Neewer account server for login authentication. When you use a third-party account to log in to your Neewer account and use the "NEEWER MASTER" service, we will use the open ID of the aforementioned account to establish an account association relationship with your Neewer account, and we will obtain the nickname and avatar information you have set up in your third-party account as your nickname and avatar for your Neewer account, Neewer account nickname and avatar. We do not collect registration information such as your third-party account username, phone number or email address.

 

If you do not provide such information and are not logged into your Neewer account, you will not be able to use the "NEEWER MASTER" application. Once you have logged in to your Neewer account, the "Neewer" app will automatically take your nickname and avatar and display them on the app page.

 

1.1.2 Improve account information

When you use the various services provided by Neewer, you can obtain better services and experience by improving basic information such as avatar, nickname, gender, birthday, etc. It will not affect the Neewer account's basic functions if you choose not to provide the above information

 

1.1.3 Basic equipment management services

 

In order to implement the function of pairing, controlling and managing devices, we need to collect the following information from you: product name, model, version. The purpose of collecting this information is to pair, control and manage the device.

 

If you do not provide this information, you will not be able to use the discovery, pairing, control and management of devices in the "NEEWER MASTER" application. 

 

1.1.4 Problem feedback service

To enable the "My Customer Service" function, we need to collect the following information from you: application and device information, your feedback email address, problem description, pictures or videos of the problem. The purpose of collecting such information is to analyze and determine the root cause of the problem. The purpose of collecting your contact information is for any follow-up to verify whether the problem has been fully resolved or to contact you for additional information as necessary.

 

We will use your personal information in the following manner: only for the purpose of locating and resolving feedback issues, not for the display of personal information.

 

If you do not provide this type of information, it will not be possible to locate and resolve your feedback effectively.

 

1.1.5 Equipment and application upgrade

 

To process application version and device firmware version upgrades, we need to collect the following information from you: the ID and type of device paired application identifier, version information and other information for detecting and downloading new versions.

 

If you do not provide us with such information, you will not be able to process the upgrade of the application version or the firmware version of the device.  

 

1.1.6 Sharing Scenes and Collaboration Groups

 

In order to implement the shared scenes and assistance groups features, we need to collect the following information from you: user-defined scenes settings, Neewer account, nickname, shared device information for setting up scenes, sharing devices and receiving device shares.

 

If you do not provide such information, you will not be able to use the shared scenes and collaboration groups features.

1.2 Use of device permissions

 

Networking permission: You need to enable this option in order to be able to access notifications, shared scenarios, account logins, etc. in the "NEEWER MASTER" application. Your authorisation is obtained when the app is launched.

 

Location Access: your current location is required to search for and connect to nearby Bluetooth devices so as to achieve device connection in the NEEWER MASTER App. In accordance with Android app permission rules, we need your permission to access your current location to discover and get nearby Bluetooth devices. Please opt to allow the App to access your location for its proper function.

 

Camera permission: You need to enable this permission in order to use the colour picker, light picker and photography utilities in the NEEWER MASTER app.

Storage permissions: In order to use My Customer Service, save settings in scenes, change avatars, etc. in the NEEWER MASTER app, you will need to select this permission to read the files stored on your device.

 

In addition to the above permissions, the app requires Bluetooth to be enabled when connecting to a Bluetooth device, if not it will not be possible to connect to the device. You can turn off Bluetooth via the system settings.

 

You can manage the permissions of this application at any time by accessing the system Settings.

 

  1. Sharing your personal information with third parties

 

To ensure that we provide you with the services described in this privacy policy, we may share necessary personal information with third parties such as partners, including:

(1)  The disclosure of your Personal Information to third party service providers that provide certain business-related services to us, such as data storage facilities, e-mail delivery services and other similar services, which enable them to provide services to us. 

(2)  The disclosure of your personal information to the company's subsidiaries or affiliates to carry out business activities on a regular basis.

(3)  We will share necessary data with third parties through application programming interfaces (API) and software tool development kits (SDK). Multiple versions of third-party SDKs may function differently and generally include types of login by third-party.

 

We promise to share personal information necessary to provide you with services only for legitimate, legal, necessary, specific, and clear purposes. In addition, we will adopt encryption and other means to ensure the safety of your information. We will stipulate the practices and obligations of third parties through contracts to ensure that third-party service providers comply with the privacy standards applicable in your jurisdiction.

 

  1. Use of SDKs

To provide and optimize our services, the NEEWER MASTER application integrates partner software development kits (" SDKS ") or other similar programs. These third-party SDKs may collect your personal information while cooperating with us to provide you with more comprehensive services. The purpose of collecting such information is to improve the services we provide to you.

We conduct rigorous security checks on SDKS or other similar applications and require our partners to take strict measures to protect your personal data.  When meeting new service requirements and business function changes, we may adjust the third-party SDK we access and inform you of the latest situation of accessing the third-party SDK in time in this policy.  At present, the application is connected to the following third-party SDKS:

  1. Personal Information Transfer

We will not transfer your personal information to any company, organization, or individual, except in the following cases:

Transfer with explicit consent: After obtaining your explicit consent, we will transfer your personal information to other parties.

When it comes to mergers, acquisitions, or bankruptcy liquidation, if it involves the transfer of personal information, we will require the new company or organization that holds your personal information to continue to be bound by this privacy policy, otherwise, we will require that the company, organization and individual seeks to obtain authorization and consent from you.

We will only publicly disclose your personal information under the following circumstances:

We may publicly disclose your personal information with your explicit consent or based on your active choice.

Law-based disclosure: We may publicly disclose your personal information when required by law, legal procedures, litigation, or under the mandatory requirements of the competent government departments

This app is for adults only. If you are a child, you need your parent or guardian to agree to your use of this application and agree to the relevant applicable terms of service. Parents and guardians should also take appropriate precautions to protect children, including supervising their use of this app.

 

For the collection of children's personal information with the consent of the parent or guardian, we will only use or publicly disclose this information when permitted by law, the parent or guardian's explicit consent, or to protect the child.

If it is in the public interest, for scientific, historical research or statistical purposes, we will continue to retain the relevant data in accordance with the applicable law, even if further data processing is not related to the original purpose of collection.

8.1 Control settings

We recognize that everyone has different privacy concerns. Therefore, we provide some examples to illustrate the various methods provided by the Neewer account for you to choose to restrict the collection, use, disclosure, or processing of your personal information, and to control your privacy settings:

(1)  Turn on or off the location access function.

(2)  Log in or unregister your Neewer account.

 

If you agreed previously to us using your personal information for the above purposes, you can send us an email to neewer.privacy@xydglobal.com at any time to change your decision.

 

8.2 Your rights to your personal information

 

You have the right to request access to, correct, or delete any personal information we hold about you in accordance with the laws and regulations of the country or territory to which you are subject (hereinafter referred to as a request). Where you have provided sufficient information to enable us to verify your identity and to ensure that the person making the request is the person who is the subject of the requested information or a person legally authorized to do so; once we have sufficient information to confirm that we can process your request, we will respond to your request within the timescales set out in the applicable data protection laws.

 

(1)   Upon your request and subject to applicable law, we may provide a record of the personal information we have collected and processed about you free of charge, and if you make additional requests for such information, we may charge you a reasonable fee based on the relevant applicable law and the actual costs of administration.

 

(2)   If you believe that any information we hold about you is incorrect or incomplete, you may request that the personal information be corrected or improved for the purposes for which it was used.

 

 

(3) Subject to your applicable laws and regulations, you may have the right to request that we delete your personal data. We will assess your request for deletion and, if the appropriate regulations are met, we will take the appropriate steps, including technical means, to process it. Once you or we have assisted you in deleting the relevant information, we may not be able to immediately delete the corresponding information from our backup systems due to applicable laws and security technology, and we will store your personal information securely and isolate it from any further processing until the backup can be erased or anonymization of it is successfully completed.

 

We have the right to refuse to process requests that are insubstantial/entangling repetitions, requests that compromise the privacy of others, requests that are extremely unrealistic, requests for disproportionate technical work, and requests that do not need to be granted under local law, information that is already in the public domain, information given under conditions of confidentiality. Data deletion or access requests may also be refused if we believe that some aspect of the request may prevent us from using the data lawfully for the aforementioned anti-fraud and security purposes.

 

8.3 Withdrawal of consent

You can submit a request by sending an email to neewer.privacy@xydglobal.com, where you can request to withdraw your consent to the collection, use, and/or disclosure of your Personal Information that we hold or control. We will process the content you submit within a reasonable period, and thereafter, we will comply with your request and will no longer collect, use and/or disclose your Personal Information.

Please note that revocation of your consent may result in certain legal consequences. Depending on the scope of information you authorize us to process, this may cause you to not be able to use Neewer's products or services. However, your decision to withdraw your consent or authorization will not affect the previous processing of personal information based on your authorization.

 

8.4 Unregister the service or account

If you want to unregister your Neewer account, you can submit the request by sending an email to neewer.privacy@xydglobal.com.  Please consider that this action will prevent you from using some or all of Neewer products and services. Prudence is advised.

 

 

8.5 Transfer personal information that is not within your authority

 

If we need to transfer personal information outside of your authority, whether it is to our affiliates (which may include communications, technology, or cloud service companies) or to third-party service providers, we shall transfer relevant information in accordance with applicable laws. In particular, to ensure that all such content transfers comply with applicable local data protection laws, we will implement appropriate security safeguards. In accordance with the regulations, you have the right to be informed of the appropriate protective measures taken by Neewer for the transmission of your personal information.

 

Neewer is a global company headquartered in China. In accordance with applicable laws, we may transfer your data to any of Neewer's subsidiaries and related companies worldwide to process such information in accordance with the provisions of this Privacy Policy. We may also transfer your data to our third-party service providers, who may be located in countries or territories outside the European Economic Area (EEA).

Whenever Neewer shares personal data from the European Economic Area with a third party, regardless of whether such third party is an entity company outside of the European Economic Area, we will share the relevant information in accordance with standard EU contract terms or any other safeguards set out in the General Data Protection Regulation.

 

Neewer may use overseas facilities operated and controlled by Neewer to process or back up your personal information. We currently have data centers in Shenzhen and the United States. Such overseas jurisdictions may or may not have provisions similar to the data protection laws in your jurisdiction. You understand that there are different risks associated with applicable data protection laws and that we may transfer and store your personal information in our overseas facilities; However, this does not change our entire commitment to protect your personal information in accordance with this Privacy Policy.

Our privacy policy may change.

We will not diminish your rights under this Privacy Policy without your express consent. We will post any changes we make to this policy on this page.

 

For major changes, we will also provide more significant notices, which include but are not limited to:

(1)  Major changes have taken place in our service model. Such as the purpose of personal information processing, the type of personal information processing, the use of personal information, etc.

(2)  The main objects of personal information sharing, transfer, or public disclosure have changed;

(3) Your rights to participate in the processing of personal information and the way to exercise them have changed considerably;

(4) Our department responsible for handling personal information security, contact information and complaint channels changes;
